Are You Facing Eviction Right Now?

IMPORTANT UPDATE: ON 8/26/2021 THE SUPREME COURT ENDED THE THE CDC EVICTION MORATORIUM. If you have a court date scheduled YOU MUST ATTEND. What you can do: apply for assistance from Kentucky Housing Corporations’s Team Kentucky Eviction Diversion Fund and contact your local Legal Aid office.

Help for Renters

-Team Kentucky Eviction Diversion Fund - (all KY counties except Fayette and Jefferson) -Healthy at Home Eviction Relief Fund - (all KY counties except Fayette and Jefferson): ALL APPLICATIONS STOPPED BEING ACCEPTED IN JANUARY, 2023. If you submitted an application before that time please reach out directly to Kentucky Housing Corporation. Funds were to be used for rent and/or utilities -JEFFERSON COUNTY/LOUISVILLE RESIDENTS: If you previously applied for rent assistance through Team Kentucky’s Healthy at Home Eviction Relief Fund, and received an email saying your landlord did not finish their portion of the application and, therefore, your application was incomplete, please click here to complete a form so that staff can advocate on your behalf. -Tenant Protections for Enterprise Backed Rental Properties- For Enterprise-backed mortgages in forbearance, property owners are not permitted to: 1) Charge late fees or penalties for back rent; 2) Require past due rent to be repaid in a lump sum; or 3) Evict a tenant without a 30- day written notice.

There are some things you may find helpful:
1) There is no eviction moratorium in place in Kentucky as of 8/26/2021.
2) Rent is not forgiven. Utility bills are also not forgiven.
4) Document any and all arrangements, deals, and conversations with your landlord through email, text messages or writing.

Primary Residence Sales Tax Exemption

If you do not have more than one home you are exempt from a new sales tax (HB 8). You should not have to do anything to be exempt from this tax. However, there has been confusion from utility companies about whether or not every Kentuckian must complete this form. To be safe, if you are a renter you may want to complete the form and submit it to all utility companies where you have service. Click here to view the form. Governor Beshear: Extend and Expand the Eviction Moratorium

Governor Beshear Issues Update to State of Emergency Relating to Utilities

On October 19, 2020 Gov. Beshear issued this update. Important takeaways: 1) Suspension of disconnections ends 11/6/2020. 2) Late fees for residential customers are waived through 12/31/2020. 3) For past due balances accumulated between 5/8/2020 - 10/25/2020: a minimum 6 month payment plan must be created* (*please refer to #3 in the Executive Order for more details about payment plans). 4) $15 million will be dedicated to the Healthy at Home Utility Relief Fund to provide relief from utility service disconnection. Contact your local Community Action Agency. 5) If you have received a shut off notice from your utility from before the new order was signed (10/19/2020), contact your local legal aid office.

On June 17, HHCK sent recommendations from a broad coalition of homeless service providers, advocates, single family homeownership developers, housing tax credit developers and landlords to outline why we must have #RentReliefNow.

Pausing Utility Rate Increases: A Letter to Attorney General Cameron

On June 8, HHCK sent Attorney General Cameron’s office a detailed letter requesting utility rates not be increased in a time when many Kentuckians are struggling to pay bills. We’re happy to report that we received this response from AG Cameron’s office on June 23.

An Open Letter to Governor Andy Beshear on Housing Needs

On April 2, we sent a collaborative letter outlining recommendations to address the needs of people experiencing homelessness and housing insecurity during this time.
